In New South Wales, it is quite easy to get caught speeding - whether detection occurs from police observation or speed cameras (mobile, fixed, or red-light). However, the consequences of speeding can be incredibly serious involving a loss of your licence. Despite the serious consequences, it’s important to remember that one fine doesn’t have to cost you your licence, employment or a clean record. Legal advice can assist in seeking a shorter suspension period, avoiding a conviction at court, or avoiding demerit points.
Elite Defence Lawyers are experienced traffic lawyers in Greater Sydney and Sutherland. We are able to provide free initial advice and fixed fees. Call now - we are available 24/7.
Speeding offences involve driving faster than the set speed limit. The penalties involved will vary based on how much over the speed limit you were travelling, your type of licence (i.e., full licence, Learners, or Provisional), whether it occurred in a school zone, the type of vehicle, and whether it was ‘double demerits’. While most speeding offences are dealt with by fines and suspensions being issued, cases may be dealt with at court where you are charged by police, ‘court elect’ a fine, or where you choose to appeal a licence suspension.
Cameras, mobile detection and police roadside enforcement are common sources of detection for speeding offences.

Understanding speeding fines NSW and speeding demerit points NSW is vital to protecting your licence. In NSW, fines and demerit points increase depending on how far over the limit you are, with harsher penalties during double demerit periods and for learner or provisional drivers. Accumulating too many points can result in suspension or licence loss.

Yes. In NSW, speeding offences can quickly lead to a loss of licence—either through demerit points or an on-the-spot police suspension. Transport for NSW (TfNSW) will automatically suspend your licence if you reach the demerit threshold: 13 points for full licence holders, 4 points for Learners and P1 drivers, and 7 points for P2 drivers.
Police may also issue an immediate suspension for serious speeding offences, such as exceeding the limit by more than 30 km/h or 45 km/h. This is separate from a demerit-based suspension imposed by TfNSW.
Losing your licence can impact your work, study, and family commitments. The good news is that legal advice can help. You may be able to appeal the suspension in court or, in some cases court may elect the fine and have the matter dealt with under a good behaviour bond to face no suspension period or accrual of demerit points.

Receiving a speeding fine can be stressful, but acting carefully may protect your licence. Follow this checklist before making any decisions:
Don’t pay immediately if you intend to dispute the fine.
Check your fine and licence status online through Service NSW.
Record all details including date, time, speed alleged, and the posted limit.
Inspect signage or camera locations to identify possible errors.
Contact a Criminal/ Traffic lawyer to review your case and explain your options.
Always seek advice before paying or accepting demerit points.
Yes. In some circumstances in NSW, you may have the right to appeal a speeding fine or licence suspension in the Local Court. Appeals are commonly made if you are facing a loss of licence for exceeding your demerit point threshold as a Learner or Provisional Licence holder or if you intend to plead not guilty to the offence and defend the charge, or if you wish to apply for a Section 10 (no conviction) to avoid demerit points and suspension.
When you lodge an appeal, the court has several options available:
Reduce the fine or penalty imposed
Grant a conditional release order without recording a conviction
Uphold the appeal to allow you to retain your licence.
Vary the suspension period to be less than the original period.
It’s important to understand that success is not guaranteed. The magistrate will take into account the seriousness of the offence, your driving history, and your personal circumstances, such as work or family commitments. Because of this, appeals can be complex, and presenting strong evidence and persuasive submissions is critical.
Engaging an experienced criminal and traffic lawyer significantly improves your chances of success. They can help you prepare supporting material, present your case effectively, and fight to protect your licence and future.
When facing a speeding charge, the right legal support can make all the difference. Our experienced Criminal & traffic lawyers focus on protecting your licence, reducing penalties, and ensuring that all procedures followed by police and Transport for NSW are carefully reviewed.
For low-level offences, we regularly achieve Section 10 dismissals or conditional release orders, allowing clients to avoid both demerit points and licence suspension. For more serious matters, we work strategically to minimise the impact on your driving record and livelihood.
Early legal advice is critical. The sooner you speak with us, the more time we have to gather evidence, prepare submissions, and present your personal circumstances persuasively to the court.
